It's interesting that people rely on consultants and body shoppers to enter this country and then curse them.
I doubt that so many people would have entered the US if it hadn't been for these very consultants and body-shoppers. Everyone knows that they pay less and take a cut of the salary. People curse them all the time and yet when it's convenient, they'll use them to get things like H1B application, labor substitution, etc. done.
I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

See if you can get a copy of the original birth certificate from the school. if you can get it, just notarize it and submit the notarized copy.

I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.

My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

I will take this oppurtunity to thank everyone who showed the courage by joining us at Washington DC.
It was a great pleasure meeting all the people from the New England area. I finally got a chance to put a face to all the names with whom i have talked on conference calls. This was just an amazing experience and i am hoping we will get a chance to have more such experiences and we will keep on continuing our efforts till the time we get the system fixed.
Folks, the rally was a huge success. The situation room (15th, 16th, 17th) was an example of all the positive energy which was builing up for the rally.
The reception(17th) was a showcase of IV. The rally(18th) was the final bang.
But inspite of having so many people affected from the GREEN CARD delays from the New England area, we just had a few folks show up at the rally. This was really disappointing.
I am sure there must be a very good reason for that. But if you have any doubts, we will really like to talk to you and clarify your doubts.
As i always say.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

pappu, ur link talks abt GC in EB-5 category. is the requirement of $1 mn investment a reqd condition for this? in other words, if an enterprise can generate jobs for 10+ US citizens by investing a lesser amt, is that valid for filing GC under EB-5 category?
