Never give childcare as a reason. INS treats this as employment for parents. But religious ceremony for child may work. For medical stuff, I'd say that you need to show that either they cant travel or they are under some treatment here. For both the reasons, you need a US doc to write a letter. The best reasons are travelling to different places in the US.

option 3 as far as I know. You only renew the 6 year term if you are out of the US more than a year. And once you switch to a different visa category, your previous one does not matter for the cap. Its only if you are transferring from an existing H1B or renewing an existing H1B that the cap doesn't come into the picture.

I would like to get your opinion on current situation.
Education: MS(Ind Engg), 5+ yrs exp.
I have priority date of Oct -2007(applied for labor under EB3). Got approved I-140 in Feb 2008( EB3 category). I got promoted to next level so requested to apply for labor once again in EB2 category in Feb 2009 and got approved labor in Feb 2010.
Is there a provision to amend labor and include previously approved I-140? Or Do I have to apply I-140 once again? and my priority date would be Feb 2009?

No labor amendement is possible. You have to go through Labor and I-140 stage again.

I think she is ok, getting an H1-B approval doesn't mean that you have to start immediately. for e.g, many of the Indian tech companies get an H1-B at the start of the year and when they have a need for that person in US, send him/her over.
Only after her first payroll would she be considered on H1-B.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

Many people wait until they at least receive the receipt notice but nothing stops you from starting with the new employer as soon as the petition is submitted (you may need to provide proof of this submission) as per AC21.
(I am not an attorney so please contact your lawyer for confirmation)
Company B applied H1B tranfer petition for me two weeks back. Our documents went to USCIS, and we didnt received receipt notice yet. To my surprise the filing fee check is also not yet encashed.
Can anyone of you please let me know, if I can start working with company B now or wait until we get the receipt notice. What is the USCIS guidelines with the start date during H1B transfer.

I think you should talk to a good lawyer immidiately. Waiting here for someone to answer would jeopardise your relatives entry back into US later. As per the law they should be leaving US as soon as you get the denials.

So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??
And if the LCA is denied because the DOL doesn't recognize the FEIN what options have we got..Can the employer reapply for LCA or just submit the Info and wait for info from DOL ??

To where you sent your 485 package. I recommend to utilize services of Attorney - primarily because they attach their cover letter with their letterhead which could make some difference
