Hi,
My husband is having L1A visa through company X.
Howmany days/moths/years will it take for us to get GREENCARD if we apply in MAY2008.
I understood no LC is required for L1A visa holders Greencard processing.

Yours will be EB1C. You can expect to get GC in 1-2 years.

I have filed I-485 in Aug2007 and am in retrogression. I am currently working for my sponsoring employer on H1 but also have EAD and AP. I have to go to India to address parents health issues and may have to stay there for possibly 6-9 months. I plan on re-entering using AP.
1) Will my GC application stay active if I am gone for such a long time?
2) My fingerprinting was done long ago - do I need to be in US when my case is adjudicated and GC approval is sent in the mail?
3) Since I will lose my current job due to the long absence, will that be an issue at POA since I wont have a current job or a job offer letter to show the IO?

My interpretation is that that there is no appeal due to the fact she has applied early, she can apply again after the 90 day clock starts ticking and she should be good. If she gets a denial again I suggest using a lawyer, there are many on this site itself in the lawyers forum. But you seriously need to be talking about the specific type of the app if you need very precise answers because USCIS treats differnt apps well differently

Can A2p the wages be pro rated ?
if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no

Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!
I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?

Both NIW and Eb-1a are DIY, so I do not have a lawyer to ask. It would be appreciated if you can share the response from your lawyer.
I am also thinking about interfiling, but it is said that both 140 have to be approved for interfiling of 485. How long does it take for interfiling? someone said it takes a long time. not sure if it is right.
